Terms of Service

Please read these terms carefully. Continued use of LinkNow means you agree to everything below.

1. Acceptance of Terms

By accessing and using LinkNow ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service.

2. Eligibility

  • Age Requirement: You must be at least 18 years old to use LinkNow.
  • Account Accuracy: You agree to provide accurate, current, and complete information during registration.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials.

3. User Conduct

You agree to use LinkNow responsibly and not to:

  • Post or share content that is illegal, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Use the Service for any unauthorized commercial purposes
  • Upload viruses or malicious code, or interfere with the proper functioning of the Service
  • Harass, stalk, or harm other users
  • Collect or store personal information about other users without their consent
  • Use automated systems (bots) to access the Service
  • Violate any local, state, national, or international law

4. Content and Intellectual Property

4.1 Your Content

  • You retain ownership of content you post on LinkNow (photos, messages, profile information)
  • By posting content, you grant LinkNow a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, and display your content for the purpose of operating and improving the Service
  • You are solely responsible for your content and the consequences of posting it

4.2 LinkNow's Property

  • All rights, title, and interest in LinkNow (including text, graphics, logos, icons, software) are owned by LinkNow
  • You may not reproduce, distribute, or create derivative works without explicit permission

5. Privacy and Location Services

  • Location Data: LinkNow uses GPS to connect nearby users. You must enable location services to use core features
  • Data Protection: Your privacy is important. See our Privacy Policy for details on how we collect, use, and protect your information
  • Control: You can disable location sharing at any time, but this may limit Service functionality

6. Premium Features and Subscriptions

6.1 Subscription Tiers and Features

LinkNow offers three subscription tiers:

  • Basic (Free): Core features including proximity matching, basic messaging, profile discovery, and event creation
  • Standard: Unlimited messaging, advanced filters, profile boosts, and enhanced matching
  • Pro: All Standard features plus AI-powered smart recommendations, advanced analytics, profile insights, premium badge, and priority customer support

6.2 Subscription Terms (Apple Guidelines Compliant)

  • Billing: Premium subscriptions are billed according to the plan you select
  • Cancellation: You may cancel your subscription at any time through account settings
  • No Refunds: All payments are non-refundable except as required by law or Apple's refund policy
  • Auto-Renewal: Subscriptions auto-renew on their recurring cycle unless cancelled before renewal date
  • Price Changes: We will notify you 30 days before any price increase. Continuing to use the service constitutes acceptance.
  • Apple iTunes Terms: Subscriptions managed through Apple App Store are governed by Apple's terms. See apple.com for details.

6.3 Free Trial Terms

  • Free trials (if offered) convert to paid subscriptions unless cancelled before trial end date
  • You will receive reminder notices before trial expiration
  • Only one free trial per user account

7. Apple App Store Compliance

7.1 Guideline Adherence

  • LinkNow complies with all Apple App Store Review Guidelines
  • We prohibit content that is explicit, offensive, or illegal
  • Age verification is enforced (18+ only)
  • All subscription disclosures are transparent and clear

7.2 COPPA & Children's Privacy

LinkNow is not intended for anyone under 18 years old. We comply with COPPA (Children's Online Privacy Protection Act) by not collecting data from minors.

7.3 Prohibited Content & Activities

  • No pornographic, obscene, or sexually explicit content
  • No promoting violence, hate speech, or harassment
  • No soliciting for illegal activities or substances
  • No impersonation or identity misrepresentation
  • No spam, pyramid schemes, or commercial solicitation

8. Messaging and Communications

  • Users can control who can message them (Anyone or Friends only)
  • Premium users can send rich media (images, videos, voice messages)
  • All users can view media sent by premium users
  • We reserve the right to monitor messages to enforce these Terms and ensure safety

9. Prohibited Activities

The following activities are strictly prohibited:

  • Creating fake or duplicate accounts
  • Selling or transferring your account to others
  • Engaging in or promoting illegal activities
  • Posting sexually explicit content or soliciting sexual services
  • Bullying, threatening, or harassing other users
  • Promoting hate speech, violence, or discrimination
  • Attempting to defraud other users or LinkNow

10. Account Termination

  • Your Right: You may delete your account at any time through Settings -> Personal Details
  • Our Right: We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice
  • Effect: Upon termination, your right to use the Service immediately ceases, and we may delete your data

11. Reporting and Safety

  • You can report users who violate these Terms using the Report User feature
  • You can block users to prevent them from contacting you
  • LinkNow takes safety seriously and will investigate reported violations
  • False reports may result in account suspension

12. Disclaimers

  • As-Is Service: LinkNow is provided "as is" without warranties of any kind
  • User Interactions: We are not responsible for users' conduct, content, or actions
  • Availability: We do not guarantee uninterrupted or error-free service
  • Third-Party Services: We are not responsible for third-party services or links

13. Limitation of Liability

To the fullest extent permitted by law, LinkNow shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or use
  • Personal injury or property damage resulting from your use of the Service
  • Unauthorized access to or alteration of your content
  • Conduct of third parties on the Service

14. Indemnification

You agree to indemnify and hold harmless LinkNow from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your content posted on the Service

15. Changes to Terms

  • We reserve the right to modify these Terms at any time
  • We will notify users of material changes via in-app notification or email
  • Continued use of the Service after changes constitutes acceptance of the modified Terms

16. Governing Law and Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the State of Florida, USA
  • Disputes: Any disputes shall be resolved through binding arbitration in Florida
  • Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
